1. Agreement to terms

By accessing or using Pointerly ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance.

2. Description of service

Pointerly provides smart deep links, bio pages, analytics, AI content, Creator Connect, and related tools for content creators and brands. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice where practicable.

3. Accounts and eligibility

You must be at least 18 years old and capable of forming a binding contract. You are responsible for maintaining the confidentiality of your account and for all activity under your account. You must provide accurate and complete registration information.

You must comply with the Amazon Associates Program Operating Agreement (and any other affiliate program terms you use) when using Pointerly to promote affiliate links.

4. Acceptable use

You may not use the Service to violate any law, infringe others' rights, or transmit harmful or illegal content. You may not attempt to gain unauthorized access to our systems or other accounts, abuse the API, or use the Service for spam or fraud.

We may suspend or terminate your account if we reasonably believe you have violated these terms or acceptable use.

5. Subscription and payment

Paid plans are billed in advance (monthly or annually). Fees are non-refundable except as required by law or as stated in our refund policy. We may change pricing with notice; continued use after the change constitutes acceptance. You are responsible for applicable taxes.

6. Intellectual property

We retain all rights in the Service, our brand, and our content. You retain rights in your content. You grant us a limited license to use, store, and display your content as necessary to provide the Service and to improve our products.

7. Disclaimer and limitation of liability

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data or revenue.

Our total liability for any claim arising from these terms or the Service is limited to the amount you paid us in the twelve months preceding the claim.
